Terms and Conditions
4People Communications may change the Terms of Use or parts thereof at any time.
4People Communications will endeavor to announce such a change within a reasonable period before it takes effect. The changes will take effect within a reasonable period after they have been announced, or after you have used the Website(s) and/or the services of 4People Communications again after the change, whichever occurs first.
If we do not enforce a provision in the Terms of Use, this does not mean that we waive the right to enforce it at a later time or against another User. Agreements that deviate from the provisions of the Terms of Use are only valid if confirmed in writing by 4 People Communications. If one or more provisions of the Terms of Use are declared invalid by a competent court, this will not affect the other provisions of the Terms of Use.
Notices to 4 People Communications (other than regarding infringing or otherwise unlawful Items) can be sent to 4 People Communications Nuenderbeekselaan 13 5673 RC in Nuenen in the Netherlands. Notices to Users will be sent to the specified e-mail address, or by registered mail if there is reason to do so and an address is available. Notices sent by registered mail will be deemed to have been received 5 (five) working days after the date of dispatch.
4 People Communications is at all times entitled to transfer its rights and obligations under the agreements relating to the services of 4 People Communications to one of its group companies. Users will be informed of this. These Terms of Use constitute the entire agreement between 4 People Communications and you and supersede all previous agreements. The agreements resulting from all services of 4 People Communications and the Terms of Use are governed by Dutch law. In the event of a dispute arising from these agreements or from the Terms of Use, only the court in Amsterdam will have jurisdiction, unless the dispute has been submitted to the Stichting Geschillencommissies Consumentenzaken. If the User acts as a consumer (a natural person who does not act in the exercise of a profession or business), then this User further has the option to choose to have the dispute settled by the legally competent court within one month after 4 People Communications invokes the jurisdiction of the court in 's-Hertogenbosch.
II Rules for posting Items
1. 4 People Communications Item platform
4 People Communications has its platform where an initiator and partner can post Items and a User can view these Items and respond to them directly and without being visible via internal mail system to item initiator.
4 People Communications is not a party to the agreement and the substantive communication that is established between an item initiator and a User and a partner. Item initiators, users and partners must resolve mutual disputes themselves.
A Partner is a user with more rights and can and may create and manage private or public partner groups of multiple item initiators, users and relations. The Partner has the same rights as described in these user conditions within its applicable paid contract period over the item initiators and users that specifically fall under its own private or public partner group(s).
2. General rules for placing an Item on the Website(s)
2.1 Items that are placed on the Website(s) by an Item initiator must comply with the general rules below.
2.2 Creating an Item:
a. In each Item for products, only one specific item subject may be offered or searched for.
b. Each title and each text of an Item must contain a description of the offered or sought product or service.
c. Titles and texts of Items may only be written in English or Dutch.
d. It is not permitted to place items more than once on the Website(s). It is not permitted to have multiple identical Items online/placed on the Website(s) simultaneously. It is not permitted to offer the same object or service in more than one Item on the Website(s) simultaneously. It is not permitted to use more than one account to place multiple identical Items or multiple Items for the same object.
e. The item content for sensitive or secret information is after own input and completely the responsibility of the item initiator.
f. It is not permitted to include a disclaimer in the Item regarding the authenticity of the Item that is offered. Item initiators must ensure that the demand or offer is real, before offering it on the website(s) of 4People Communications.
3. Placing an Item
3.1. Placing an Item
An Item initiator places his Item via the button 'place Item ' on the Website(s). Before an Item initiator can place an Item, he must first log in and have rights to place an item for a certain period against payment. If a user is affiliated with a Partner, he must first approve the user before an item can be created and becomes visible. An item initiator who wants to make an item publicly visible but is affiliated with a closed group of a partner must first be approved by the Partner administrator before the item becomes publicly visible. When creating a user account, it is not permitted to choose an advertiser name that contains a [url] or part of a [url].
It is not permitted to provide your login details to third parties if you are an official Partner for a fee. It is not permitted to use login details of third parties to place Items.
3.2. Establishment of Item agreement between 4 People Communications, a Partner and an Item initiator.
a. After the Item initiator has logged in, he can create an Item via the 'Place Item' button. During the creation of the Item, the Item is visible to the item initiator only for the applicable period. The Item initiator can change the Item based on this example. After viewing the example, the 'send' button can be clicked. The Item agreement is concluded between 4 People Communications and the Partner and the Item initiator at the moment that the payment procedure on the Website(s) has been completed.
b. 4 People Communications stores all data of each Item agreement for 14 days after the Item has been removed. We will then store the data of the Item agreement as described in our Privacy policy. The Item initiator can request this data within 14 days by using the contact form, stating the e-mail address with which the Item was placed and stating the Item number.
3.3. Period that an Item remains on the Website(s)
Items for which no special rules apply will remain on the Website(s) for at least 28 days, provided that the applicable (payment) conditions have been met and the Item initiator does not remove the Item himself. For Items for which special rules apply, you will see the conditions on our Website(s) before placing your Item.
If the solution, question or competition agreement term of an offered item is met, the Item must be removed. Upon execution and termination of the Item is offered, the Item agreement between you and 4 People Communications ends, and 4 People Communications has fully complied with its obligations under the Item agreement. A partner has the right to actively offer its users access to place items within its agreement term.
3.4. Standing out
When creating the Item, the Item initiator has the option to have his Item 'stand out', 'place it higher', etc. The rules for this are described on the corresponding web pages.
3.5 Payment online immediately in advance or by means of a continuous SEPA authorization.
If you have provided 4 People Communications with a continuous (SEPA) authorization for the collection of amounts owed by you to 4 People Communications, we will, before we collect an amount from the specified bank account, inform you of this at least one day in advance by e-mail.
4. Right of termination
4.1 In certain cases, the right of termination as referred to in article 6:230o of the Dutch Civil Code may apply to a partner and the placement of an Item.
4.2 In any case, the right of termination does not apply to Items that have been (i) removed from the Website(s) on the basis of the provisions in the Terms of Use (including on the basis of Chapter I, article 6) or (ii) have been placed by Users who are excluded from the services of 4 People Communications or for whom certain restrictions apply.
4.3 Unless otherwise agreed, you agree that a partner or Item will be placed immediately, during the statutory termination period. This has consequences for any applicable right of termination. You also declare that you waive any applicable right of termination, as soon as 4 People Communications has fulfilled the Item agreement.
4.4 If the right of cancellation referred to in article 4.1 applies to the partner and/or Item placed by you, you agree that if you exercise your right of cancellation, you owe 4 People Communications a proportional fee for the services provided by 4 People Communications. In certain cases, this proportional fee will be calculated based on the number of days remaining from the agreed partner or Item period as agreed with 4 People Communications when you exercise your right of cancellation.
4.5 If you exercise your right of cancellation, 4 People Communications will refund the price of the service, reduced by a proportional fee, within 14 days of your cancellation request.
If you are a consumer, you have the right to cancel the agreement concluded between you and 4 People Communications under certain circumstances. Below you will find more information about the right of cancellation and how you can exercise this right.
When do I have the right to cancel, and within what period must I cancel?
The right of cancellation applies to certain agreements for services (such as automatic renewal of partners) when the service has not yet been fully performed by 4 People Communications.
The cancellation period expires 14 days after the day on which your agreement with 4 People Communications was concluded.
The right of cancellation does not apply in the following situations:
• The service is by its nature directly performed in full by 4 People Communications if the performance of the agreement has begun with your consent;
• Delivery of digital content that is not supplied on a tangible medium, if the performance has begun with your express prior consent.
How do I exercise my right of cancellation?
You can exercise the right of cancellation by sending us a signed request by e-mail to 4 People Communications. We must receive your unambiguous statement to exercise your right of cancellation before the cancellation period of 14 days has expired.
What happens if I exercise my right of cancellation?
If you choose to exercise your right of withdrawal, you must stop the agreed services and make this known via the form above. You are entitled to a proportional compensation of the amount we have already received from you, based on a combination of the remaining number of days of the partner agreement or the item and the average number of leads for comparable 4 People Communications services (as determined from time to time by 4 People Communications). We will pay you this amount in any case no later than 14 days after the day on which we received your decision to terminate the agreement.
We will refund you using the same payment method with which you made the original transaction, unless you expressly agree otherwise. No costs will be charged for this refund.
5. Mutual agreements and offers are not binding
5.1. Unless otherwise provided in these Terms of Use, an agreement or offer on an item, product or service or question or competition in an Item is not binding. An Item initiator is not obliged to accept an agreement or such (reasonable) offer. If an appointment such a bid is accepted by an Item initiator, this does not oblige the bidder to purchase.
5.2. If the Item is deleted due to the expiry of the placement period or for another reason, the associated contacts will also be deleted.
It is not permitted to place appointments and bids with Items.
5.2. If the Partner is deleted due to the expiry of the period or for another reason, the associated accounts and items will also be deleted.
6. Rules for offering the price/payment methods in an Item
6.1. An Item initiator may not oblige a User to use certain payment methods in an Item.
6.2. An Item initiator is not permitted to state only part of the price in the price field of the Item.
6.3. Item initiators who offer their goods and services to private individuals as entrepreneurs are required to state prices including VAT in an Item on the basis of article 38 of the Turnover Tax Act.
7. Reporting Illegal or Infringing Items to 4 People Communications
7.1. Reports of Items in Violation of the Terms of Use
a. An Infringement Report can only be used by holders of intellectual property rights or their agents and legal authorities (see more about this under 6.2). Items that otherwise violate the Terms of Use, such as Items that offer illegal products or that contain libelous content, can be reported by e-mail to 4 People Communications.
b. Abuse of the Report to 4 People Communications is considered an action in violation of the Terms of Use and may result in us taking the measures described in Chapter I, Article 6 against the relevant reporter.
7 .2. Reports in the event of infringement of intellectual property rights
a. The purpose of reporting infringement is to ensure that products offered in Items do not infringe the copyright, trademark rights or other intellectual property rights of third parties.
b. Rights holders may report an Item that infringes their rights and request the removal of this Item by sending a substantiated e-mail to 4 People Communications according to the instructions. Once this has been received and checked, 4 People Communications will remove the Item in question.
c. The purpose of the review and request for evidence is to ensure that the party reporting the Item is the rights holder itself or has been officially authorized by the rights holder. This information must also enable us to identify the Item that must be removed.
8. We do not provide any guarantees
8.1. Item initiators and Users must conduct sufficient research and obtain sufficient information before placing an Item on the Website(s). We do not perform any checks on the quality of the content of the Item, the safety or legality of the offer or questions, competitions, the correctness, the authority of Item initiators to sell products or offer services and/or the authority of Users to purchase products or use the services. 4 People Communications does not provide any guarantees in this regard.
8.2. 4 People Communications cannot guarantee that the Items offered by item initiators on the Website(s) will meet your expectations.
9. Indemnification of Item service and limitation of liability of 4 People Communications
9.1. Each User indemnifies 4 People Communications against claims from third parties relating to damage suffered by;
(i) entering into an agreement based on an Item,
(ii) entering into an agreement based on a Partner,
(iii) the use of Items offered via the Website(s) with agreements resulting therefrom
(iv) the (allegedly) infringing and/or otherwise unlawful nature of the (content of the) Item and/or the delivered product or service.
9.2. The conditions for the limitation of liability of 4 People Communications are included in Chapter I, Article 8.
10. Amendments
10.1. 4 People Communications may change the Website(s) or parts thereof, including the Partner duration and Item duration, renewal options, the layout of the groups and categories, the layout of the Website(s) and search options, at any time and at its own discretion. We will endeavor to announce such changes within a reasonable period of time before they are implemented.
10.2. 4 People Communications may change the prices of the paid Partners and Items at any time. If a price increase occurs during the term of an Item agreement that exceeds the CBS consumer price index figure, the Item initiator has the right to terminate this partner or Item agreement.
11. The Item may also be published elsewhere
11.1. 4 People Communications may use the Item(s) and their content for its own website(s) and publicity purposes. This includes that an Item or part thereof may be shown by us through other distribution channels, such as on Website(s) that are part of a third party Website(s), in print media or on television.
11.2. By posting an Item, you automatically grant 4 People Communications a royalty-free, worldwide, irrevocable, sub-licensable and transferable license to use, reproduce, distribute and make public (and to allow third parties to use and reproduce) the Item and/or (parts of) its content for marketing, promotional and/or Item purposes. You warrant that you are authorized to grant this license.
11.3. We may provide third parties with access to an Item for publicity purposes to enable them to promote this and other Items on third-party Websites, via e-mail and through other channels. These promotions may include (parts of) the Item.
11.4. The layout of Items may be modified in such a way that the Items are accessible from mobile devices or other third-party software applications.
11.5. The Website(s) contain references (for example by means of a hyperlink or banner) to third-party Website(s). These references may also be placed in or next to an Item. 4 People Communications has no say or influence on the content and policy of these Website(s). The (privacy) rules of the relevant Website(s) apply to these Website(s).
